Terms and Conditions

Kindly read carefully all the below terms and conditions. Once you book and confirm services with us, by default you accept these terms and conditions.

General

The booking conditions detailed herein contain the entire contract between you and Dana East Africa Safaris. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation. This contract may only be varied in writing by a duly authorized officer of Dana East Africa Safaris.

This contract and all matters arising out of it are governed by the Republic of Kenyan law. We both agree that any dispute, claim or other matter which arises out of or in connection with this contract or your holiday will be dealt with by the Courts of the Republic of Kenya only. Changes to these Booking Conditions will only be valid if agreed by Dana East Africa Safaris in writing. Dana East Africa Safaris does not own hotels, restaurants, aircrafts and other services and only acts as an AGENT.

Service Booking & Confirmation

As soon as you make a booking/reservation with Dana East Africa Safaris, you will be required to pay at least 30% deposit in order for us to secure the services for you. The remaining payment should be made not less than 60 days to the commencement date of the service booked.

Once we have accepted and make reservations for you, we will send you an email confirming the services booked. A pro forma invoice will also be sent to you at that point in time. We accept no responsibility for incorrect email or inability to deliver email. If your confirmation does not arrive on time or at all, you must ask us to re-send the email confirmation.

We reserve the right to cancel any services reserved without full payment or a deposit.

It is the responsibility of the passenger/agent to check the accuracy of the services confirmed including dates, accommodation and all other services booked upon receipt of the final confirmation documents from us.

Travel Insurance

No travel insurance cover included in our prices for the services booked with us. We strongly recommend that you take comprehensive insurance cover for cancellation, medical expenses, personal accident, personal baggage, money and public liability before you travel.

We take no responsibility for any injuries or loss to you incurred whilst you are taking part in any optional activities that are outside the services booked with us.

We accept no responsibility for the theft, loss or damage to personal belongings at any time during the duration of your safari.

Cancellation Policy

Cancellation of your booking must be in writing or by email to Dana East Africa Safaris and will only be effective from the date it is received in our offices. Dana East Africa Safaris reserves the right to claim a cancellation fee of up to 100% of the total package price. Reservations that are cancelled or reduced in length of stay or number of participants (collectively called a CANCELLATION) will resort in the following charges based on the total package cost:-

  1. More than 90 days before departure 10%
  2. 90 – 45 days before departure 30%
  3. 44 – 25 days before departure 50%
  4. 24 – 15 days before departure 80%
  5. Less than 15 days before departure 100%

Refunds

Dana East Africa Safaris shall do all within our ability to deliver on all services booked and paid for with us. The company cannot however accept to give any refunds for any reason for specific tour sections; accommodation, excursions or meals missed or denied to guests during the tour. No refunds will be made for no shows, or any unused services.

Service Changes

Dana East Africa Safaris reserves the right to change our itinerary in the event of happenings outside our control. This includes political unrest, diseases, revolution, national or local strikes and/or protests and social disorder.

We reserve the right to decrease or increase the price of our services at any time due to Government action like review of the Value Added Tax, changes in exchange rates, increase in transportation costs due to considerable fuel price changes, airfares or hotel rates review.

At the PEAK SEASON months or specific times when demand is beyond our fleet of vehicles, we reserve the right to contract quality private transport providers to assist us in carrying passengers. In such cases we will do our best to contract vehicles of equal standard as ours.

Luggage restrictions

All passengers are limited to one standard suitcase (soft bag) not weighing more than 15 kg on domestic scheduled and charter flights. For the limited space in the safari vehicle especially for guests traveling in group to share safari vehicle we recommend not more than 20kg luggage per person in soft bags.

Travelling & Obedience

Whilst travelling, you must obey the laws of the countries you are visiting booked with Dana East Africa Safaris. We would ask you to respect the diverse cultures that exist in those countries.

Dana East Africa Safaris representative may need to make a decision in the interests of safety. It is a condition of booking that you comply with the authority and decisions of the appointed representative. If you do not comply with the said representative and are not compatible with the general enjoyment and well being of members of the tour, we reserve the right to refuse to allow you to continue the tour. In such a case we will not be liable for any refund, compensation or any additional costs incurred by you.

Dana East Africa Safaris cannot accept liability for the behavior of others on your tour nor if any facilities are curtailed as a result of their actions.

Punctuality

It is your responsibility to meet your tour at arranged points and at the right time. Dana East Africa Safaris will not be liable if any service leaves or arrives later than its specified time, even if as a result you miss a connecting service. Dana East Africa Safaris will endeavour to ensure that departure and arrival times are met.

Obligations and responsibilities

You must inform us in writing of any medical condition that’s requires attention or medication before your tour commences.

It is your responsibility to have all necessary travel documents – visas, passports, permits and certificates required for your selected itinerary as well as any necessary vaccinations and to comply with all applicable laws.

During your tour our tour guide may take photographs and films of you while you are a passenger and these may be used in our brochures and/or advertising and publicity material without obtaining any further consent or payment in respect of such photographs and/or films.

When you book with Dana East Africa Safaris, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss must be paid at the time direct to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims (including legal costs) subsequently made against us as a result of your actions.

You are obliged to respect the right of residents living close to our hotels/resorts and other services used by us during your tour. You must live free from noise, vandalism or any other source of annoyance. Any tour member who contravenes this policy will be reported to the local police authorities.

At all times you must show courtesy and respect to your driver/guide and more importantly the other tour members. Failure to do so may result in you being asked to leave the tour at the management’s discretion.

Complaints

In the highly unlikely event that you may wish to make a formal complaint against Dana East Africa Safaris, kindly inform our representative at the time. If the matter cannot be resolved immediately or during your trip after the driver/ representative’s best endeavors to do so, your complaint should be made in writing to  Dana East Africa Safaris as soon as is reasonably possible after the holiday, but within 30 days thereof so that your complaint can be investigated. Dana East Africa Safaris will not consider any claims after the 30-day period. You will be assured of respect and courtesy whilst your complaint is being dealt with.

Weather Conditions

Under no circumstances can Dana East Africa Safaris be held responsible for weather conditions that may affect the delivery and implementation of our itinerary.

No Smoking Policy

We do not permit smoking on any of our vehicles. Some hotels/lodges and resorts do not allow smocking and so are some public areas you may be visiting while on safari with us. Please comply with the law at all areas you visit while on safari with us.
